Technical dispute and arbitration support for an OEM in South America

Supporting an original equipment manufacturer (OEM) in a complex arbitration process related to contractual and operational performance issues.

Our role focused on the independent technical analysis of disputed issues, including contract compliance, O&M performance and component-level technical issues. This involved a detailed review of technical documentation, performance data and contractual obligations to establish a clear and defensible technical position aligned with the arbitration strategy.

We worked closely with the OEM legal team to define the defense strategy from both a technical and contractual perspective, contributing industry expertise to bridge legal arguments with engineering and operational realities. Our analysis covered multiple components and systems, allowing for a structured assessment of root causes, contractual responsibilities and performance deviations.

As part of the process, we prepared and delivered multiple expert witness reports addressing the relevant technical and contractual issues and participated in the arbitration proceedings as technical experts. The work provided a robust, evidence-based foundation to support the client’s position in a high-stakes dispute.
